(AP) — California's attorney general and 10 cities and counties are suing the paint industry, seeking to get them to pay $1 billion to remove hazardous lead paint from old homes in the state.
The San Jose Mercury News reports (http://bit.ly/15fT82t ) that the trial starting Monday in Santa Clara County Superior Court will decide if industry is responsible for the use of lead-based paint throughout the state decades ago.
The industry argues that lead paint, which has been banned in California for decades, was never sold deliberately to consumers and is no longer a significant risk to public health.
Lead paint remains in California homes built before 1978.
Exposure to lead is linked to learning disabilities and other health problems, especially in children.
Judge James Kleinberg will decide the case.
